A man accused of drowning two of his disabled sons and trying to kill his ex-wife by driving them off a Los Angeles wharf for an insurance payout gets 212 years in federal prison for fraud. 45 year-old Ali F. Elmezayen received the maximum sentence from a judge who denounced an “evil and diabolical scheme.”
U.S. District Judge John R. Walter said: “He is the ultimate phony and a skillful liar and is nothing more than a greedy and brutal killer. The only regret that the defendant has is that he got caught.”
Elmezayen has also been ordered to pay $261,751 in restitution to the insurance companies as a federal jury convicted him of mail fraud, wire fraud, aggravated identity theft and money laundering in 2019.
In 2015 when the car fell into the water, Elmezayen was charged in the federal fraud case and accused by local prosecutors of murder, attempted murder for financial gain.
The murder charges were arranged to be prosecuted after the federal case.
Greg Risling, a spokesman for the Los Angeles County district attorney said: “A bench warrant has been issued and our office is evaluating the next step.”
According to federal prosecutors, in 2012 and 2013 Elmezayen bought $3 million worth of life and accidental death policies on himself and his family from eight insurance companies. The 45 year-old accused paid more than $6000/year in premiums for policies while reporting his income less than $30,000. He began buying the policies the same year he exited a Chapter 11 bankruptcy.
He frequently called the companies to verify if the policies were active and they would pay benefits if his ex-wife dies in an accident and they wouldn’t investigate the claims made 2 years after the purchase.
Elmezayen drove with his ex-wife and the two youngest children off a commercial fisherman’s wharf in San Pedro area of the Port of Los Angeles.
On April 9, 2015, twelve days after the two-year contestability period on the last of his insurance policies expired, Elmezayen drove a car carrying his ex-wife and two youngest children off a commercial fishermen’s wharf in the San Pedro area of the Port of Los Angeles.
Elmezayen and his wife got out through the driver’s window as a fisherman rescued her. The boys who were 8 and 13 had severe autism, couldn’t escape the car.
